PLEASE READ THIS AGREEMENT CAREFULLY. THIS AGREEMENT IS NOT A CONTRACT OF INSURANCE OR WARRANTY SUBJECT TO THE FEDERAL MAGNUSSON-MOSS ACT. THIS AGREEMENT AFFECTS YOUR LEGAL RIGHTS AND INCLUDES IMPORTANT INFORMATION REGARDING CANCELLATION AND AN ARBITRATION AGREEMENT.


 

1. Plan Introduction

1.1. Welcome to Your iRobot Protection Plan. This document outlines all the details of Your Plan, such as coverage information, instructions on how to file a claim, cancellation policies, and lots more. Please reach out to iRobot at  or 1-(877) 855-8593 should You have any questions, or the Administrator at support@extend.com or 1-(877) 248-7077.


2. Your Responsibilities

2.1. Please read these terms and conditions carefully so that You fully understand Your coverage under this Plan. There are some limits, conditions, obligations, and exclusions designed to keep this Plan affordable for You and manageable for Us.
2.2. This Plan does not replace Your manufacturer warranty, maintenance plan, or insurance policy You may have for the Covered Product. This is not a contract of insurance.
2.3. You must maintain the Covered Product as recommended by the manufacturer's owner’s manual or any product warranty.
2.4. You must keep this Plan and Your Purchase Confirmation as You may be required to produce them to obtain service. Refer to Your Purchase Confirmation to determine the Coverage Term, and other important information that may affect Your coverage under this Plan, and if there is a Deductible required to obtain service.


3. How to File a Claim

3.1. Please contact iRobot for assistance with initial troubleshooting and any additional customer support needs. You can reach iRobot customer support by calling the toll-free number at 1-(877) 855-8593 or at https://homesupport.irobot.com/s/contactsupport.
3.2. In order to file a claim, You will need to notify the Administrator by contacting iRobot after the failure occurs as soon as practicable and You will be advised on how to obtain service or a replacement. To do so, go online at https://homesupport.irobot.com/s/contactsupport or call the toll-free number at 1-(877)-855-8593 between 9:00 AM and 9:00 PM eastern standard time Monday through Friday or between the hours of 9:00AM and 6:00 PM eastern time Saturday through Sunday. Please note that iRobot is not the Administrator, and You may be contacted by the Administrator during the claim process.
3.3. Do not return the Covered Product to the Selling Retailer or obtain unauthorized service unless instructed to do so during the claim filing process.


4. Definitions

4.1. Accidental Damage from Handling (ADH): damage during normal usage from a single, unexpected, sudden, and unintentional event. Does not include accumulated damage from continual or multiple events. See . for more details.
4.2. Administrator: Extend, Inc., 2701 Sunset Ridge Dr #602, Rockwall, TX 75032, 1-(877) 248-7707.
4.3. Coverage Term: the period that Your Covered Product is covered under this Plan and shown on Your Purchase Confirmation. (Coverage may expire prior to the end of the Coverage Term according to Section 8.4.)
4.4. Covered Product: the iRobot product shown on Your Purchase Confirmation. The Covered Product will include nonconsumable accessories, such as a charging station or Automatic Dirt Disposal, used in conjunction with the iRobot product and sold by the Selling Retailer collectively with the iRobot product under a single SKU number.
4.5. Deductible: the applicable deductible, if any, for claims. Any deductibles will be shown on Your Purchase Confirmation.
4.6. Extend, Our, Us, or We: the Obligor obligated to perform under this Plan.
4.7. Plan: this plan or service contract between You and Us, which may be a “Protect+ plan” that includes Accidental Damage from Handling, or “Protect” Plan.
4.8. Plan Price: the price You paid for this Plan.
4.9. Purchase Confirmation: Your purchase confirmation email from the Selling Retailer for the purchase of this Plan.
4.10. Obligor: The obligor of this Plan is Extend Warranty Services Corporation, 2701 Sunset Ridge Dr #602, Rockwall, TX 75032, 1-(877) 248-7707 except in Florida, Oklahoma, and Washington, where the obligor of this Plan is Extend Protection Corporation, 2701 Sunset Ridge Dr #602, Rockwall, TX 75032, 1-(877) 248-7707.
4.11. Selling Retailer: the entity selling the Covered Product and this Plan as shown on Your Purchase Confirmation.
4.12. You, Your, or Purchaser: the purchaser of the Covered Product and this Plan, and any authorized transferee/assignee of the purchaser.


5. Eligibility

The following products are eligible for coverage:

5.1. iRobot Products, including, but not limited to, robot vacuums, robot mops, coding robots, Root® educational robots, and non-consumable product accessories.


6. What is Covered


6.1. STANDARD COVERAGE covers mechanical or electrical failure due to a defect in materials or workmanship, or power surge, that is experienced during use during the Coverage Term. Your coverage (as further described in Section 8) begins upon the expiration of the manufacturer or retailer warranty. This Plan does not replace Your manufacturer warranty, maintenance plan, or insurance policy You may have for the Covered Product.
6.2. Accidental Damage from Handling (ADH) Coverage: If You purchased a Protect+ Plan, Your Plan includes ADH Coverage as shown on Your Purchase Confirmation. In addition to the coverage described Section 6.1. above, Your Covered Product is protected against ADH such as drops, liquid spills, and pet damage during the Coverage Term. You will be required to pay a Deductible if a Deductible is shown on Your Purchase Confirmation. Coverage is provided for only operational or mechanical failure caused by ADH. It does not include protection against theft, mysterious disappearance, misplacement, viruses, reckless, abusive, willful, or intentional conduct associated with handling and use of the Covered Product, cosmetic damage and/or other damage that does not affect the unit functionality, damage caused during shipment between You and Our service providers, and any other damage listed in the “What is Not Covered” Section of this Plan. A claim under this coverage requires an explanation of where and when the accident occurred as well as a detailed description of the actual event. Failure to provide this information may result in claim denial.
6.3. Battery Coverage: In addition to the coverage described in Section 6.1. above, Your Plan will include up to one (1) battery repair or replacement during each year of the Coverage Term if the rechargeable batteries that are included with the Covered Product fail due to a defect in materials or workmanship. You will be required to pay a Deductible if a Deductible is shown on Your Purchase Confirmation, and We may require You to return Your original defective battery to Us to receive a replacement battery. Battery coverage is only available for Covered Products that are new, or manufacturer certified refurbished products. There is no Plan coverage for failures covered or those that should be covered by any manufacturer or retailer warranty.


7. What is Not Covered

The following is not covered by Your Plan, unless specifically provided in the “What is Covered” Section:

7.1. products not originally covered by a manufacturer’s warranty or retailer guarantee unless the product is certified used or refurbished as shown on Your Purchase Confirmation,
7.2. products with less than an original thirty (30) days manufacturer’s parts and labor limited warranty,
7.3. product repairs that should be covered by the manufacturer’s warranty or are a result of a recall, regardless of the manufacturer’s ability to pay for such repairs,
7.4. failures covered by any insurance policies or other agreements,
7.5. cleaning, periodic checkups, or preventive maintenance,
7.6. damage from pre-existing conditions that occurred prior to the Coverage Term,
7.7. parts requiring replacement or repairs due to normal wear and tear unless resulting from a covered failure, and items normally designed to be periodically replaced by You during the life of the product, including but not limited to batteries (unless covered in Section 6.3. and shown on Your Purchase Confirmation), consumable accessories such as filters, light bulbs, brushes, etc.,
7.8. damage from abnormal use, abuse, misuse, mishandling, neglect, introduction of foreign objects into the Covered Product, unauthorized modifications, or alterations to a Covered Product,
7.9. damage to Covered Products caused by a battery leakage,
7.10. failure caused by Your lack of following the manufacturer’s instructions for operation and care of the Covered Product,
7.11. damage due to fluctuations or interruptions in electric power, ISP (internet service provider) service or wireless networks, including failures due to weak and/or inconsistent wireless signal strength,
7.12. damage to software, data and any support, configuration, installation or reinstallation of any software or data,
7.13. external causes of any kind, including third party actions, fire, theft, insects, animals, exposure to weather, windstorm, sand, dirt, hail, earthquake, flood, water, acts of God or consequential loss of any nature,
7.14. loss or damage caused by invasion, rebellion, riot, strike, labor disturbance, lockout, or civil commotion,
7.15. lost or stolen Covered Products,
7.16. incidental, consequential, or secondary damages, including loss, damage, or injury to person(s) or property, or delay in rendering service under this Plan, or loss of use during the period You are awaiting a replacement,
7.17. any product purchased for or used at any time for commercial purposes or on a rental basis,
7.18. failures that occur outside of the fifty (50) states of the United States of America and the District of Columbia,
7.19. damage to non-functional or aesthetic parts or components that does not affect the functionality of the Covered Product,
7.20. scratches, peeling & dents,
7.21. unauthorized repairs and/or parts,
7.22. battery failure if the battery has short-circuited, the seals of the battery enclosure or the cells are broken or show evidence of tampering or the battery has been used in equipment other than the Covered Product,
7.23. cost of installation, setup, diagnostic services for the Covered Product, except as specifically provided herein,
7.24. accessories used in conjunction with a Covered Product including remote controls, unless included as a part of the Covered Product in accordance with Section 4.4.,
7.25. any other loss other than a covered failure,
7.26. service where no problem can be found,
7.27. noises, squeaks,
7.28. failures which are not reported during the Coverage Term,
7.29. any failure or condition that results from abnormal usage of the Covered Product.


8. Service Procedures and Limit of Liability

In the event of a covered loss, We will repair or, at Our discretion, replace Your Covered Product or damaged part with a new or refurbished unit, up to the Limit of Liability. The replacement product or part may be of a future or current version of Your original Covered Product. In cases where replacement is not reasonably possible, You will be paid a cash settlement reflecting the replacement cost of a new comparable product, subject to the Limit of Liability. We will take the following actions:

8.1. Depot Repair: We will provide You with a prepaid shipping label for You to ship Your failed Covered Product to Our repair facility. Your Covered Product must be properly protected with bubble wrap or other protective materials, at Your own expense. We are not responsible for and have no liability for products damaged during shipping. Your repaired Covered Product will be mailed back to You at no charge. All repairs must be authorized by the Administrator prior to performance of work or else claims may be denied. SERVICE COSTS, BREAKDOWN CHARGES, INSPECTION FEES OR ESTIMATE CHARGES FOR REPAIRS NOT COVERED UNDER THIS PLAN ARE YOUR RESPONSIBILITY.
8.2. Replacement: If Your Covered Product cannot be repaired and is eligible for replacement, We will provide You with a prepaid shipping label for You to ship Your failed Covered Product to Our facility. Your Covered Product must be properly protected with bubble wrap or other protective materials at Your own expense. If the claim to Your Covered Product is covered, a replacement unit will be mailed to You at no charge. Your replacement unit will be covered under your Plan, unless you have reached the Limit of Liability as described in Section 8.3.
8.3. Limit of Liability: The most We will cumulatively pay for all repairs, replacements or settlements for your Covered Product is the retail price You paid for the Covered Product, excluding sales tax, delivery, and handling. This Plan shall expire, and We shall have satisfied all Our obligations under this Plan upon payment to You of a cash settlement in lieu of replacement or if the total of all repairs or replacements exceeds the retail price You paid for the Covered Product, excluding sales tax, delivery, and handling fees. Refer to Sections 6.1., 6.2. and 6.3. for additional claim limitations.
8.4. Expiration: This Plan shall expire upon the earliest of the Coverage Term ending, payment to You of a cash settlement in lieu of replacement or if the total of all repairs or replacements exceeds the retail price You paid for the Covered Product, excluding sales tax, delivery, and handling fees.


9. Cancellation

9.1. You may cancel this Plan for any reason at any time by contacting Us through iRobot at 1-(877) 855-8593 or https://homesupport.irobot.com/s/contactsupport. Cancellation requests made within sixty (60) days of when You purchased this Plan (“Purchase Date”), if no claim has been made under the Plan, will receive a 100% refund of the Plan Price. Cancellations requests made more than sixty (60) days from the Purchase Date, or if a claim was made under the Plan within the first sixty (60) days, will receive a pro-rata refund of the Plan Price based on the elapsed Coverage Term, less the costs of repairs made (if any), and less an administrative fee not to exceed the Plan Price or $50, whichever is less.
9.2. If You cancel this Plan within sixty (60) days from the Purchase Date, and if no claim has been made under the Plan, then We will pay a ten percent (10%) penalty for each month that a refund is not provided within thirty (30) days of Your notice of cancellation.
9.3. We may not cancel this Plan except for fraud, material misrepresentation, or non-payment by You, or if required to do so by a regulatory authority. A written notice will be provided at least thirty (30) days prior to cancellation at Your last known address, with the effective date for the cancellation and the reason for cancellation. You will receive 100% of the unearned pro-rata Plan Price based on the elapsed Coverage Term, less the costs of repairs made (if any).
9.4. If this Plan was inadvertently sold to You on a product which was not intended to be covered by this Plan, and no claims were paid, We will cancel this Plan back to its inception and return the full Plan Price to You.


10.Conditions

10.1. Renewal: Renewal of Your Plan will be at Our discretion.
10.2. Transferability: This Plan is transferable by the original Purchaser for the balance of the original Coverage Term. The transfer must be registered by contacting Us through iRobot at 1-(877) 855-8593 or https://homesupport.irobot.com/s/contactsupport and providing the date of new ownership, new owner’s name, complete address, and telephone number. The manufacturer’s warranty may not be transferable. This Plan does not replace the manufacturer’s warranty and provides no coverage therein, except as noted above.
10.3. Territories: The sale of this Plan is limited to the geographic area of the United States of America, including the District of Columbia, only. It does not include any U.S. Territories, including Guam, Puerto Rico, or U.S. Virgin Islands, or Canada.
10.4. Subrogation: If We pay or render service for a loss, We may require You to assign Us Your rights of recovery against others. We will not pay or render service for a loss if You impair these rights to recovery. Your rights to recover from others may not be waived. You will be made whole before We retain any amount We may recover.


11. Legal Disclosures

11.1. DISPUTE RESOLUTION/ARBITRATION AGREEMENT AND CLASS ACTION WAIVER: You agree that all individual claims or disputes arising from or relating to this Plan, whether in contract, tort, pursuant to statute, regulation, ordinance or in equity or otherwise and whether Your dispute is with Administrator, Obligor, Selling Retailer, or the insurer listed in Section 11.4., Insurance, will be settled by impartial arbitration. To initiate arbitration, You must notify the Administrator in writing of Your desire to submit Your issue to arbitration. You are responsible for providing the Administrator with at least three (3) proposed arbitrators. Administrator has the right to question the proposed arbitrators to confirm neutrality and select any of the three to act as the Arbitrator. If the Administrator demonstrates that none of the three proposed arbitrators are neutral, You may be asked to proffer additional arbitrators until one is selected. The Arbitrator is responsible for setting the ground rules and procedures for the arbitration. You agree to abide by the Arbitrator’s decision and share the cost of arbitration equally unless the Arbitrator directs otherwise. If this section conflicts with the statutory or regulatory arbitration provision in the state in which this Agreement was purchased, the state’s arbitration rules will govern.
11.2. Entire Agreement: This Plan, together with Your Purchase Confirmation, shall collectively constitute the entire agreement relating to Your coverage. These documents will confirm Your eligibility to receive service under this Plan. No verbal or written representations by any Selling Retailer or marketing materials outside of this Plan shall be of any legal effect to this Plan.
11.3. Severability: Any provision contained herein which is found to be contrary to applicable laws shall be deemed null and void and the remaining provisions shall continue in full force and effect.
11.4. Insurance: Our obligations under this Plan are guaranteed under service contract reimbursement policies issued by Continental Casualty Company and The Continental Insurance Company, 151 N. Franklin St., Chicago, IL 60606, 1- 800- 831-4262. If We fail to pay or provide service on any valid claim under this Plan within sixty (60) days after proof of loss has been filed, or We cease to do business or go bankrupt, You may make a direct claim to the insurance companies.


12. State Requirements and Disclosures

Alabama: The administrative fee in Section 10.1. is revised to state that it will not exceed the cost of the contract or $25, whichever is less. If an emergency situation occurs after normal business hours and We cannot be reached, You can proceed with repairs. If covered under the terms of this Plan, We will reimburse You or the service vendor in accordance with the Plan provisions. You must submit all receipts and documentation within 48 hours of the emergency situation.
Arkansas: If an emergency situation occurs after normal business hours and We cannot be reached, You can proceed with repairs. If covered under the terms of this Plan, We will reimburse You or the service vendor in accordance with the Plan provisions. You must submit all receipts and documentation within 48 hours of the emergency situation.
Arizona: The Cancellation Provision is revised to state: We may not cancel or void this Plan for any of the following reasons: 1) due to acts or omissions of Us or Our assignees or subcontractors for their failure to provide correct information or their failure to perform the services or repairs provided in a timely, competent and workmanlike manner; 2) Preexisting conditions that were known or that reasonably should have been known by Us or the person selling the Plan on Our behalf; 3) Prior use or unlawful acts relating to the Covered Product; 4) Misrepresentation by either Us or the person selling the Plan on Our behalf. The Cancellation Provision is revised as follows: the administrative fee shall not exceed ten percent (10%) of the gross amount paid by You or $50, whichever is less. Claims paid will not be deducted from any refund amount due. We will not exclude preexisting conditions if such conditions were known or should reasonably have been known by Us or the Selling Retailer. The Arbitration provision, 12.1., is revised to state: Arbitration cannot be an absolute dispute remedy and both parties must agree to arbitration. This arbitration provision does not prohibit an Arizona resident from following the process to resolve complaints under the provisions of A.R.S. §20-1095.09, Unfair trade Practices as outlined by the Arizona Department of Insurance and Financial Institutions. To learn more about this process, You may contact the Arizona Department of Insurance and Financial Institutions at 100 N. 15th Ave., Suite 261, Phoenix, AZ 85007-2630, Attn: Consumer Protection. You may directly file any complaint with the A.D.I.F.I. against a Service Company issuing an approved Service Contract under the provisions of A.R.S. §§ 20-1095.04 and/or 20- 1095.09 by contacting the Consumer Protection Division of the A.D.I.F.I. at 602-364-2499.
California: The Cancellation Provision is revised as follows: If You cancel this Plan within sixty (60) days after Your receipt of the Plan, and no claims have been made, We shall refund or credit You the full Purchase Price of the Plan. If Yo has been made, We shall refund or credit You a pro rata refund based on elapsed time or an objective measure of use such as the retail value of any service performed. If You cancel this Plan more than sixty (60) days from the date of purchase, We shall refund or credit You a pro rata refund based on elapsed time or an objective measure of use such as the retail value of any service performed, less an administrative fee not to exceed ten percent (10%) of the Purchase Price or $25, whichever is less. If You cancel this Plan, a 10% per annum interest payment for each additional thirty (30) days or fraction thereof shall be added to a refund that is not paid or credited within 30 days after cancellation.
Colorado: The Cancellation Provision is revised as follows: the administrative fee shall not exceed ten percent (10%) of the gross provider fee paid by You or $50, whichever is less.
Connecticut: If this Plan is for less than a period of one (1) year, this Plan will be automatically extended while the Covered Product is in Our custody for repair under the terms of this Plan. If You are unable to resolve any disputes arising under this Plan, You may file a formal written complaint with the Consumer Affairs Division of the Connecticut Insurance Department at PO Box 816, Hartford, CT 06142-0816. You are entitled to utilize the Insurance Commissioner’s arbitration process to settle any disputes arising under this Plan.
District of Columbia: The Cancellation Provision is revised as follows: the administrative fee shall not exceed ten percent (10%) of the gross provider fee paid by You or $50, whichever is less.
Florida: The Cancellation Provision is revised as follows: the administrative fee shall not exceed ten percent (10%) of the unearned pro rata premium or $50, whichever is less. The rate charged for this Plan is not subject to regulation by the Office of Insurance Regulation. Our license number is: 49935.
Georgia: The Cancellation Provision is revised as follows: If You cancel this Plan within sixty (60) days from the date of purchase, We shall refund or credit You the full Purchase Price of the Plan, decreased by the amount of claims paid under the Plan. If You cancel this Plan more than sixty (60) days from the date of purchase, We shall refund or credit You the prorated Purchase Price of the Plan based on elapsed time of the Plan, decreased by the amount of claims paid under the Plan, and less an administrative fee not to exceed 10% of the unearned pro rata Purchase Price, or $50, whichever is less. If You cancel this Plan within sixty (60) days from the date of purchase, then We will pay a penalty of ten percent (10%) for each month that a refund is not provided within thirty (30) days of Your notice of cancellation. The Arbitration Provision, 11.1., is revised to state that arbitration is non-binding. In Section 7. What is Not Covered, 7.6, is deleted and replaced with the following: damage from pre-existing conditions known to you that occurred prior to the Coverage Term,
Illinois: The Cancellation Provision is revised as follows: the administrative fee shall not exceed ten percent (10%) of the Purchase Price or $50, whichever is less.
Maine: The Cancellation Provision is revised as follows: If You cancel this Plan within sixty (60) days from the date of purchase, and if no claim has not been made under the Plan, then We will pay a monthly penalty of ten percent (10%) of the provider fee outstanding for each month that a refund is not provided within thirty (30) days of Your notice of cancellation. The administrative fee shall not exceed ten percent (10%) of the provider fee paid by You or $50, whichever is less. The Insurance provision, 11.4., is revised as follows: If We fail to pay or provide service on a claim, including any claim for the return of the unearned portion of the provider fee, within 60 days after proof of loss has been filed, You are entitled to make a claim directly against the insurance company.
Maryland: The Cancellation Provision is revised as follows: If You cancel this Plan within sixty (60) days from the date of purchase, and if no claim has not been made under the Plan, then We will pay a penalty of ten percent (10%) of the value of the consideration paid for the Plan for each month that a refund is not provided within 30 days of Your notice of cancellation. This Plan is extended automatically when We fail to perform the services under the Plan. This Plan does not terminate until the services are provided in accordance with the terms of the Plan.
Michigan: If the Covered Product under this Plan is a home appliance, then the following applies: If performance of the Plan is interrupted because of a strike or work stoppage at Our place of business, the effective period of the Plan shall be extended for the period of the strike or work stoppage.
Nevada: The Cancellation Provision is revised as follows: If You cancel this Plan within sixty (60) days from the date of purchase, and if no claim has not been made under the Plan, then We will pay a penalty of ten percent (10%) of the Purchase Price for each 30-day period or portion thereof that a refund is not provided within thirty (30) days of Your notice of cancellation. If this Plan has been in effect for at least 70 days, We may not cancel before the expiration of the agreed term or one (1) year after the effective date of the Plan, whichever occurs first, except on any of the following grounds: (a) Failure by the holder to pay an amount when due; (b) Conviction of the holder of a crime which results in an increase in the service required under the Plan; (c) Discovery of fraud or material misrepresentation by the holder in obtaining the service contract, or in presenting a claim for service thereunder; (d) Discovery of: (1) An act or omission by the holder; or (2) A violation by the holder of any condition of the Plan, which occurred after the effective date of the Plan and which substantially and materially increases the service required under the Plan; or (e) A material change in the nature or extent of the required service or repair which occurs after the effective date of the Plan and which causes the required service or repair to be substantially and materially increased beyond that contemplated at the time that the Plan was issued or sold. Claims paid will not be deducted from any refund owed. The cancellation fee shall not exceed the Purchase Price or $25, whichever is less. If You are not satisfied with the manner in which We are handling a claim under the Plan, You may contact the Nevada Commissioner of Insurance via the toll-free telephone number (888) 872-3234.
New Hampshire: In the event You do not receive satisfaction under this Plan, You may contact the New Hampshire Insurance Department at 21 South Fruit Street, Suite 14, Concord, NH 03301, or via telephone: 1 (800)-735-2964.
New Jersey: If You cancel this Plan within sixty (60) days from the date of purchase, and if no claim has not been made under the Plan, then We will pay a ten percent (10%) penalty, based on the Purchase Price of the Plan, for each month that a refund is not provided within thirty (30) days of Your notice of cancellation.
New Mexico: The Cancellation Provision is revised as follows: the administrative fee shall not exceed ten percent (10%) of the Purchase Price of the Plan or $50, whichever is less. If You cancel this Plan within sixty (60) days from the date of purchase, and if no claim has not been made under the Plan, then We will pay a penalty of ten percent (10%) of the Purchase Price for each thirty-day period or portion thereof that a refund is not provided within thirty (30) days of Your notice of cancellation. If this Plan has been in effect for at least 70 days, We may not cancel before the expiration of the agreed term or one (1) year after the effective date of the Plan, whichever occurs first, except on any of the following grounds: (1) failure by the holder to pay an amount when due; (2) conviction of the holder of a crime that results in an increase in the service required under the Plan; (3) discovery of fraud or material misrepresentation by the holder in obtaining the Plan or in presenting a claim for service thereunder; or (4) discovery of either of the following if it occurred after the effective date of the Plan and substantially and materially increased the service required under the Plan: (a) an act or omission by the holder; or (b) a violation by the holder of any condition of the Plan.
New York: If an emergency situation occurs after normal business hours and We cannot be reached, You can proceed with repairs. If covered under the terms of this Plan, We will reimburse You or the service vendor in accordance with the Plan provisions. You must submit all receipts and documentation within 48 hours of the emergency situation.
North Carolina: The Cancellation Provision is revised as follows: We may only cancel this Plan for nonpayment or a direct violation of the Plan by the consumer where the Plan states that the violation of the Plan would subject the Plan to cancellation. The administrative fee shall not exceed ten percent (10%) of the amount of the pro rata refund or $50, whichever is less.
Oklahoma: The Cancellation Provision is revised as follows: the administrative fee shall not exceed ten percent (10%) of the unearned pro rata premium or $50, whichever is less. Oklahoma license number: 514801679. This is not an insurance contract. Coverage afforded under this Plan is not guaranteed by the Oklahoma Insurance Guaranty Association.
Oregon: Section 11.1. is deleted and replaced as follows: Any decision to settle a dispute by arbitration must be a mutual agreement by the parties. If mutually agreed upon, then arbitration shall be conducted under local rules as required under ORS Chapter 36. If an emergency situation occurs after normal business hours and We cannot be reached, You can proceed with repairs. If covered under the terms of this Plan, We will reimburse You or the service vendor in accordance with the Plan provisions. You must submit all receipts and documentation within 48 hours of the emergency situation.
South Carolina: In the event of a dispute with the provider of this contract, You may contact the South Carolina Department of Insurance, Capitol Center, 1201 Main Street, Ste. 1000, Columbia, South Carolina, 29201 or by phone at (800) 768-3467. If an emergency situation occurs after normal business hours and We cannot be reached, You can proceed with repairs. If covered under the terms of this Plan, We will reimburse You or the service vendor in accordance with the Plan provisions. You must submit all receipts and documentation within 48 hours of the emergency situation.
Texas: The Insurance provision, 11.4., is revised as follows: You may apply for reimbursement directly with the insurer if a covered service is not provided to You by Us before the 61st day after the date of proof of loss, or a refund or credit is not paid before the 46th day after the date on which You cancel the Plan. The Cancellation Provision is revised as follows: If You cancel this Plan within sixty (60) days from the date of purchase, We shall refund or credit You the full purchase price of the Plan, decreased by the amount of claims paid under the Plan. If You cancel this Plan more than sixty (60) days from the date of purchase, We shall refund or credit You the prorated purchase price based on elapsed time of the Plan, decreased by the amount of claims paid under the Plan, and less an administrative fee not to exceed the cost of this Plan or $50, whichever is less. If You cancel this Plan, then We will pay a penalty of ten percent (10%) of the amount outstanding for each month that a refund is not provided within thirty (30) days of Your notice of cancellation. Unresolved complaints concerning providers and administrators or questions concerning the regulation of service contract providers and administrators may be addressed to the Texas Department of Licensing and Regulation at 920 Colorado, Austin, Texas 78701, or via telephone: 1-(800) 735-2989.
Utah: Section 11.4. is revised to state: If We fail to pay or provide service on any claim under this Plan within sixty (60) days after proof of loss has been filed, or We cease to do business or go bankrupt, You may make a direct claim under Our service contract reimbursement insurance policy. This Plan is subject to limited regulation by the Utah Insurance Department. To file a complaint, contact the Utah Insurance Department. Coverage afforded under this Plan is not guaranteed by the Property and Casualty Guaranty Association. P We may not cancel this Plan except for: material misrepresentation; substantial change in the risk assumed, unless We should have reasonably foreseen the change or contemplated the risk when entering into the contract; or substantial breach of contractual duties, conditions, or warranties, including non-payment. If We cancel, We will mail to You via firstclass mailing written notice at least thirty (30) days in advance, stating the reason and effective date of cancellation. ANY MATTER IN DISPUTE BETWEEN YOU AND THE COMPANY MAY BE SUBJECT TO ARBITRATION AS AN ALTERNATIVE TO COURT ACTION PURSUANT TO THE RULES OF (THE AMERICAN ARBITRATION ASSOCIATION OR OTHER RECOGNIZED ARBITRATOR), A COPY OF WHICH IS AVAILABLE ON REQUEST FROM THE COMPANY. ANY DECISION REACHED BY ARBITRATION SHALL BE BINDING UPON BOTH YOU AND THE COMPANY. THE ARBITRATION AWARD MAY INCLUDE ATTORNEY'S FEES IF ALLOWED BY STATE LAW AND MAY BE ENTERED AS A JUDGEMENT IN ANY COURT OF PROPER JURISDICTION. If an emergency situation occurs after normal business hours and We cannot be reached, You can proceed with repairs. If covered under the terms of this Plan, We will reimburse You or the service vendor in accordance with the Plan provisions. You must submit all receipts and documentation within 48 hours of the emergency situation.
Vermont: If an emergency situation occurs after normal business hours and We cannot be reached, You can proceed with repairs. If covered under the terms of this Plan, We will reimburse You or the service vendor in accordance with the Plan provisions. You must submit all receipts and documentation within 48 hours of the emergency situation.
Virginia: If any promise made in the Plan has been denied or has not been honored within sixty (60) days after Your request, You may contact the Virginia Department of Agriculture and Consumer Services, Office of Charitable and Regulatory Programs to file a complaint.
Washington: The Arbitration provision, 11.1., is revised to state: Arbitration proceedings may be held at a location in closest proximity to Your permanent residence. If an emergency situation occurs after normal business hours and We cannot be reached, You can proceed with repairs. If covered under the terms of this Plan, We will reimburse You or the service vendor in accordance with the Plan provisions. You must submit all receipts and documentation within 48 hours of the emergency situation.
Wisconsin: THIS CONTRACT IS SUBJECT TO LIMITED REGULATION BY THE OFFICE OF THE COMMISSIONER OF INSURANCE. We may only cancel this Plan for nonpayment of the provider fee, material misrepresentation by You to Us or Administrator, or substantial breach of duties by the You relating to the Covered Product or its use. The Cancellation Provision is revised as follows: If You cancel this Plan within sixty (60) days from the date of purchase, and if no claim has not been made under the Plan, then We will pay a ten percent (10%) penalty of the refund amount outstanding for each month that a refund is not provided within 30 days of Your notice of cancellation. The administrative fee shall not exceed ten percent (10%) of the provider fee or $50, whichever is less. In the event of a total loss of property covered by a service contract that is not covered by a replacement of the property pursuant to the terms of the contract, a service contract holder shall be entitled to cancel the service contract and receive a pro rata refund of any unearned provider fee, less any claims paid. The Arbitration provision, 11.1., is revised to state that arbitration is non-binding.

EXTENDED SERVICE AGREEMENT

(for purchases made prior to 05/01/2022)

This Agreement is not a Contract of Insurance or a Warranty subject to the Federal Magnusson-Moss Act.

PLEASE READ THIS AGREEMENT CAREFULLY, as it describes the protection You will receive in return for Your payment of the purchase price of this Agreement and it contains a Dispute Resolution/Arbitration Agreement and Class Action Waiver. You must keep this Agreement, Your sales invoice or receipt for the product You purchased. They are integral parts of this Agreement and You may be required to produce them to obtain service. You must maintain the Covered Product as recommended by the manufacturer's owner’s manual and product warranty. Refer to Your sales invoice or receipt to determine the term of this Agreement, whether You purchased a Replacement or Repair Plan, and if there is a Deductible required to obtain service. You acknowledge Your understanding of the Limited Applicability of the Federal Magnusson-Moss Warranty Act as set out below in this Agreement.

NOTICES: (1) THE PURCHASE OF THIS AGREEMENT IS NOT REQUIRED TO EITHER PURCHASE YOUR COVERED PRODUCT OR TO OBTAIN FINANCING; (2) THIS AGREEMENT DOES NOT REPLACE THE MANUFACTURER’S WARRANTY OR SELLING RETAILER’S LIMITED PRODUCT WARRANTY, IF ANY, ON YOUR COVERED PRODUCT.

1. DEFINITIONS:

“We”, “Us” and “Our”: the company obligated under this Agreement, 4warranty Corporation, 10151 Deerwood Park Blvd., Building 100, Suite 500, Jacksonville, FL 32256 (800-867-2216), in all states except in Florida and Oklahoma where it is Lyndon Southern Insurance Company, 10151 Deerwood Park Blvd., Building 100, Suite 500, Jacksonville, FL 32256 (800) 888-2738, Florida License No. 03698 and Oklahoma License No. 44200929, and in Wisconsin where it is The Service Doc Inc., 10151 Deerwood Park Blvd., Building 100, Suite 500, Jacksonville, FL 32256 (800) 867-2216;
“You” and “Your”: the purchaser of the Covered Product(s) and any authorized transferee/assignee of the purchaser.

“Administrator”: [Extend, Inc., 301 Howard St., Suite 1410, San Francisco, CA 94105. Phone: [877-248-7707].

“Selling Retailer”: iRobot Corporation, 8 Crosby Drive, Bedford, MA 01730;

“Covered Product”: the consumer item(s) which You purchased concurrently with and is covered by this Agreement;

“ADH”: ‘Accidental Damage In Handling’ of Your Covered Product as defined in section (9) of this Agreement; and

“Deductible”: this Agreement has a [$0 - $150] deductible per occurrence for ADH claims involving pet damage and rechargeable batteries.

2. WHEN YOUR PLAN BEGINS AND ENDS:

A. One-Time Pay Plans: If You paid for Your Plan in one payment, coverage under Your Plan will end one, two, three, four or five years from the date on which it started depending on the length of the Plan You purchased unless it is renewed or cancelled, or obligations under the Plan become fulfilled in their entirety, in accordance with the limit of liability.
B. Continuous Monthly Plans: If You select a Plan that automatically renews on a month-to-month basis, coverage under Your Plan will continue and You authorize Administrator or Selling Retailer to charge Your credit or debit card for the amount specified on Your payment receipt each month until Your Plan is cancelled, We have fulfilled Our obligations under this Plan in accordance with the limit of liability, or We discontinue the monthly renewals. Your account must be current to receive service.

3. PRODUCT ELIGIBILITY: The following products are eligible for coverage:

• iRobot Products, such as robot vacuums, robot mops, coding robots, root educational robots, product accessories and rechargeable batteries.

4. REPLACEMENT PLAN:

Term: If You purchased a replacement plan without ADH Coverage, the term of this Agreement is effective immediately upon the expiration of the shortest portion of the manufacturer’s warranty and continues for the period indicated on Your sales invoice or receipt, or until a claim is paid, whichever occurs first. If You purchased a replacement plan that includes ADH Coverage, the term of the Agreement begins on the date of purchase indicated on Your sales invoice or receipt, or until a claim is paid, whichever occurs first.

Coverage: We will replace Your Covered Product due to a mechanical or electrical breakdown, including those experienced during normal wear and tear or due to Accidental Damage in Handling (“ADH”), if elected, and as defined below. A mechanical or electrical breakdown caused by a direct result of a power surge is also covered. The Covered Product must fail during normal usage. At Our sole option We will replace Your Covered Product with a new or refurbished unit of like or similar quality. The replacement product may at Our option be a future version or current edition of Your original product. Coverage will apply to accessories that are sold as a bundle and used in conjunction with the Covered Product. In all cases where replacement is not possible You will be paid the retail value of Your Covered Product not to exceed the purchase price, excluding sales tax, delivery, and handling.

Limit of Coverage Liability: The limit of liability under the replacement plan is the value of the Covered Product at the time of purchase, excluding sales tax, delivery and handling. This Agreement shall expire upon replacement of Your Covered Product or issuance of a compensation check in lieu of replacement. For Continuous Monthly Plans, if We have fulfilled two (2) claims during Your Agreement term (excluding claims where We only replace Your battery on Your existing Covered Product) by replacing Your Covered Product with a refurbished product. If We replace Your Covered ProductYour replacement device will become the Covered Product under Your Continuous Monthly Plan.

What to do when Your Covered Product fails to Operate: Do not return the Covered Product to the Selling Retailer where You purchased Your Covered Product. Contact the Administrator and You will be advised on how to obtain replacement.

• Call the toll-free number at [(877) 248-7707 between the hours of 9:00 AM and 9:00 PM eastern standard time Monday through Friday or between the hours of 9:00 AM and 6:00 PM eastern standard time Saturday through Sunday.]
• We will issue You a service order number, or equivalent (SO#). You must ship Your defective item to the address provided to YouYou must write the SO# on the outside of the package. Products found to be non-defective will be returned to You unrepaired.
• You are not responsible for the cost of postage and/or shipping. Your product must be properly protected with bubble wrap or other protective materials.

5. REPAIR PLAN:

Term: If You purchased a repair plan without ADH Coverage, the term of this Agreement is effective upon the expiration of the shortest portion of the manufacturer’s warranty and continues for the period indicated on Your sales invoice or receipt, or until the limit of liability has been met, whichever occurs first. If You purchased a repair plan that includes ADH Coverage, the term of the Agreement begins on the date of purchase indicated on Your sales invoice or receipt, or until the limit of liability has been met, whichever occurs first. In the event Your Covered Product is being serviced by an authorized service center when this Agreement expires, the term of this Agreement will be extended until covered repair has been completed.

Coverage: We will repair or replace the Covered Product, at Our discretion, due to a mechanical or electrical breakdown, including those experienced during normal wear and tear, or from Accidental Damage in Handing, if elected, and as defined below. A mechanical or electrical breakdown caused by a direct result of a power surge is also covered. Parts will be replaced with those of like kind and quality. We may use new or remanufactured parts. If the Covered Product cannot be repaired; if the cost of the repair exceeds the original purchase price; if parts are no longer available or are discontinued by the manufacturer, the Covered Product will be replaced as determined by Us with a product of similar quality and features. We will replace Your rechargeable battery if it fails to hold a charge per the manufacturer guidelines. You are limited to one (1) battery replacement claim per year, subject to the applicable Deductible.

Limit of Coverage Liability: Our limit of liability for Your Covered Product under the Repair Plan is the cost of authorized repairs, or replacing Your Covered Product two (2) times with a refurbished product as determined by Us, with a product of like quality and similar features, provided however, in no event will Our total liability for repairs or replacement exceed Your purchase price for the Covered Product, excluding sales tax, delivery and installation costs. Upon replacement, there is no longer any obligation for the replaced product under this Agreement. For Continuous Monthly Plans, if We have fulfilled two (2) claims during Your Agreement term (excluding claims where We only replace Your battery on Your Covered Product) by replacing Your Covered Product with a refurbished product. If We replace Your Covered ProductYour replacement device will become the Covered Product under Your Continuous Monthly Plan.
SERVICE COSTS, TRIP CHARGES, BREAKDOWN CHARGES, INSPECTION FEES OR ESTIMATE CHARGES FOR REPAIRS NOT COVERED UNDER THIS AGREEMENT ARE YOUR RESPONSIBILITY.

6. No Lemon Policy: During the term of this Agreement, and subject to Our limit of liability, after three (3) service repairs have been completed on the same component of an individual Covered Product and that Covered Product component requires a fourth repair, as determined by Us, We will replace it with a product of comparable performance. Upon replacement, there is no longer any obligation for the replaced product under this Agreement.

7. All repairs must be authorized by the Administrator prior to performance of work. Claims on unauthorized repairs may be denied. Many oversights, which are not covered under this Agreement, can be due to simple circumstances such as the Covered Product not being switched on, being unplugged, or a fuse blown at the junction box. For a Covered Product that uses batteries as the prime power supply, check that the batteries do not need recharging.

8. Service Deliverables: There may be a Deductible required to obtain service for Your Covered ProductYou will receive service on Your Covered Product as described below:

Depot: We will provide You with a prepaid shipping label for You to ship your failed product to Our repair facility. You may be responsible for a portion or all costs of postage, insurance, packaging and shipping. Your product must be properly protected with bubble wrap or other protective materials. We are not responsible for and have no liability for product damaged in shipping. Your repaired product will be mailed back to You at no charge.

9. ACCIDENTAL DAMAGE IN HANDLING (“ADH”):

If You purchased a plan that includes ADH Coverage, Your Covered Product is protected against accidental damage in handling such as drops, liquid spills and pet damage (which may be subject to a Deductible) based on the term length selected. ADH only covers operational or mechanical failure caused by an accident from handling and does not include protection against theft, mysterious disappearance, misplacement, viruses, reckless, abusive, willful or intentional conduct associated with handling and use of the Covered Product, cosmetic damage and/or other damage that does not affect the unit functionality, damage caused during shipment between You and Our service providers and any other limitations listed in the “What is Not Covered” section of this Agreement. Any resultant damage from this type of treatment is NOT covered by this ADH program. For the purpose of this Agreement, Accidental Damage is defined as a single, unexpected, sudden and unintentional event and does not include accumulated damage from continual or multiple events. The use of this coverage requires an explanation of where and when the accident occurred as well as a detailed description of the actual event. Failure to provide this information will result in claim denial. ADH coverage is limited to one (1) repair or replacement with a refurbished device during the term of a One-Time Pay Plan or Continuous Monthly Pay Plan Agreement.

10. WHAT IS NOT COVERED:

(A) Products not originally covered by a manufacturer’s warranty; (B) Products with less than an original thirty (30) days manufacturer’s parts and labor limited warranty; (C) Product repairs that should be covered by the manufacturer’s warranty or are a result of a recall, regardless of the manufacturer’s ability to pay for such repairs; (D) Cleaning; Periodic checkups; preventive maintenance; (E) Any and all pre-existing conditions that occur prior to the effective date of this Agreement and/or any product sold used or “AS-IS”, including but not limited to floor models, demonstrations models, etc.; (F) Part or repairs due to normal wear and tear unless tied to a breakdown, and items normally designed to be periodically replaced by You during the life of the product, including but not limited to filters, brushes, non-rechargeable batteries, disposal bags, pads, etc.; (G) Damage from abuse, misuse, mishandling, introduction of foreign objects into the Covered Product, unauthorized modifications or alterations to a Covered Product; failure to follow the manufacturer’s instructions for operation and care of the Covered Product; external causes of any kind, including third party actions; fire; theft; insects; exposure to weather; windstorm; sand; dirt; hail; earthquake; flood; water; acts of God or consequential loss of any nature; (H) Loss or damage caused by invasion; rebellion; riot; strike; labor disturbance; lockout; or civil commotion; (I) Incidental, consequential or secondary damages or delay in rendering service under this Agreement; loss of use during the period that the Covered Product is at an authorized service center or awaiting parts; (J) Any product used in a commercial setting or rental basis; (K) Failures that occur outside of the 50 states of the United States of America and the District of Columbia; (L) Non-functional or aesthetic parts including but not limited to frames, doors, hinges, plastic parts, knobs, rollers, baskets; scratches, peeling & dents; (M) Unauthorized repairs and/or parts; (N) Cost of installation, setup, diagnostic charges, of the Covered Product, except as provided herein; (O) Any other loss other than a covered breakdown; (P) Service where no problem can be found; noises; squeaks; breakdowns which are not reported during the term of this Agreement; (Q) any breakdown or condition that results from abnormal usage of the Covered Product; (R) coin mechanisms.

11. CONDITIONS:

 Renewal: Renewal of Your plan will be at Our discretion. See Section (2) for details for renewal by plan.
• Transferability: This Agreement is transferable by the original purchaser for the balance of the original extended protection period. The Covered Product may be registered to the new owner by calling [877-248-7707], and providing the date of new ownership, new owner’s name, complete address, and telephone number. The manufacturer’s warranty may not be transferrable. This Agreement does not replace the manufacturer’s warranty and provides no coverage therein, except as noted above.
• Territories: The Agreement territory is limited to the geographic area of the United States of America, including the District of Columbia, only. It does not include any U.S. Territories including Guam, Puerto Rico, or U.S. Virgin Islands, and does not include Canada.
• Subrogation: If We pay or render service for a loss, We may require You to assign Us Your rights of recovery against others. We will not pay or render service for a loss if You impair these rights to recover. Your rights to recover from others may not be waived. You will be made whole before We retain any amount We may recover.

12. DISPUTE RESOLUTION/ARBITRATION AGREEMENT AND CLASS ACTION WAIVER:
PLEASE READ THIS DISPUTE RESOLUTION/ARBITRATION AGREEMENT AND CLASS ACTION WAIVER, INCLUDING THE OPT-OUT PROVISION, CAREFULLY TO UNDERSTAND YOUR RIGHTS. IT REQUIRES THAT CLAIMS (AS DEFINED BELOW) BE RESOLVED SOLELY THROUGH BINDING ARBITRATION ON AN INDIVIDUAL BASIS, RATHER THAN BY A JURY OR IN A CLASS ACTION.

Arbitration is a method of resolving any Claim without filing a lawsuit. In this Arbitration Agreement and Class Action Waiver (collectively including all of this section of this Agreement), You, We, and the Administrator (the “Parties”) are agreeing to submit any and all Claims to binding arbitration on an individual basis for resolution. This Arbitration Agreement and Class Action Waiver sets forth the terms and conditions of our agreement to binding arbitration. The Parties agree that any and all claims, disputes and controversies arising under or related in any way to this Agreement, including but not limited to claims related to the underlying transaction giving rise to this Agreement, claims related to the sale or fulfillment of this Agreement, and claims against any third-party (including the Selling Retailer and/or any of its owners, shareholders, members, affiliates, subsidiaries, divisions, directors, officers, employees, representatives, successors, and assigns) arising under or related in any way to this Agreement or the underlying transaction or the sale or fulfillment of this Agreement (collectively, “Claims”), shall be resolved by final and binding arbitration. “Claims” shall be given the broadest meaning possible and includes, without limitation, Claims arising under contract, tort, statute, regulation, rule, ordinance or other rule of law or equity, and Claims against any of Our or the Administrator’s owners, shareholders, members, affiliates, subsidiaries, divisions, directors, officers, employees, representatives, successors, or assigns. “Claims” does not include a claim for public injunctive relief brought under any California statute enacted for a public reason, provided that You are a California resident or purchased Your Service Contract in California. In arbitration, Claims are resolved by an arbitrator and not by a judge or jury. THE PARTIES, INCLUDING YOU, WAIVE ANY RIGHT TO HAVE CLAIMS DECIDED BY A JUDGE OR JURY. In addition, except as expressly stated in the Class Action Waiver or otherwise expressly stated herein, the arbitrator shall have exclusive authority to decide all issues related to the enforcement, applicability, scope, validity, and interpretation of this Arbitration Agreement, including but not limited to any unconscionability challenge or any other challenge that the Arbitration Agreement is void, voidable or otherwise invalid. Notwithstanding this agreement to arbitrate, each of the Parties retains the right to seek remedies in small claims court to resolve any Claim, on an individual basis, within the jurisdiction of small claims court. You acknowledge Your understanding that all Parties hereunder are waiving their rights to go to court, except for small claims court, to resolve any Claims arising under or related in any way to this Agreement.

The Parties agree and acknowledge that the transaction evidenced by this Agreement affects interstate commerce. The Parties further agree that all issues relating to this Arbitration Agreement and Class Action Waiver, including its enforcement, scope, validity, interpretation, and implementation, will be determined pursuant to federal substantive law and the substantive and procedural provisions of the Federal Arbitration Act (“Act”), 9 U.S.C. §§ 1-16. If federal substantive law holds that state law should apply to any issue relating to this Arbitration Agreement and Class Action Waiver, then the law of the state where You purchased the Agreement shall apply, without regards to conflicts of law.

CLASS ACTION WAIVER. All Claims must be brought solely in an individual capacity, and not as a plaintiff or class member in any purported class action, collective action, representative action, mass action, private attorney general action or action on behalf of the general public, or similar proceeding (any such action is referred to herein as a “Class Action”). NO CLAIM WILL BE ARBITRATED ON A CLASS ACTION BASIS. The Parties, including You, expressly waive any right or ability to bring, assert, maintain, or participate as a class member in any Class Action in court, arbitration, or any other forum, and the right for anyone to do so on Your behalf. The arbitrator may not consolidate more than one person or entity’s claims, and may not otherwise preside over any Class Action. The arbitrator shall not have the authority to combine or aggregate multiple persons’ or entities’ Claims or discovery, to conduct a Class Action or to make an award to any person or entity not a party to the arbitration. Notwithstanding anything to the contrary, the Parties agree that the enforcement, applicability, scope, validity, and/or interpretation of this Class Action Waiver shall be decided by a court of competent jurisdiction and not by an arbitrator. If this Class Action Waiver is ruled unenforceable or is interpreted to not prevent a Class Action, then the Arbitration Agreement shall be null and void, and any Claims shall proceed in a court of law and not in arbitration. The Parties agree that if an arbitrator renders a decision regarding the enforcement, applicability, scope, validity, and/or interpretation of this Class Action Waiver, or determines that a Class Action may proceed in arbitration, then: (1) the arbitrator has exceeded his powers, pursuant to §10(a)(4) of the FAA, by taking such action; (2) either party may seek immediate review of that decision by a court of competent jurisdiction; and (3) a court of competent jurisdiction shall apply a “de novo” standard of review of that decision if such standard of review is allowed by the common law or statutes of that state. The Parties, including You, agree that if for any reason a Claim proceeds to Court, rather than arbitration, (1) the Claim will proceed solely on an individual, non-class, non-representative basis, and (2) no Party may be a class representative or class member or otherwise participate in any Class Action.

The arbitration shall be administered by the American Arbitration Association (“AAA”). The arbitration shall be conducted pursuant to the AAA Consumer Arbitration Rules (the “Code”). Information on AAA and a copy of the Code may be found at the following number and URL: American Arbitration Association, (800) 778-7879, www.adr.org. The arbitration will be governed by federal substantive law and the substantive and procedural provisions of the Federal Arbitration Act (“Act”), 9 U.S.C. §§ 1-16. If federal substantive law holds that state law should apply to any issue relating to the arbitration, then the law of the state where You purchased the Agreement shall apply, without regards to conflicts of law. The arbitration will occur before a single, neutral arbitrator selected in accordance with the Code in effect at the time the arbitration is commenced. If Your total damage claims (not including attorney’s fees) do not exceed $25,000, then all Claims shall be resolved by the Code’s Procedures for the Resolution of Disputes through Document Submission, except that a Party may ask for a hearing or the arbitrator may decide that a hearing is necessary. If a hearing is held, You have a right to attend the arbitration hearing in person, and You may choose to have any arbitration hearing held in the county in which You live, the closest AAA location to Your residence, or via telephone. In the event that the specified arbitration forum is unavailable, the Parties may agree on a substitute arbitration forum. If the Parties cannot agree, a court of competent jurisdiction may appoint a substitute arbitration forum. For information about how to initiate arbitration with the AAA, the Parties may refer to the AAA Code and forms at www.adr.org or call (800) 778–7879. If You initiate arbitration with AAA, You must pay the AAA filing fee in an amount no greater than the fee You would have to pay if You filed a complaint in federal court. We will pay any remaining Costs of arbitration required by the Code (“Arbitration Costs”); however, if the arbitrator determines that any of your claims are frivolous, you shall bear all of the Arbitration Costs. If We initiate arbitration against You, We will pay the AAA filing fee and the Arbitration Costs. Each party will pay his/her/its own attorney’s fees, as well as costs relating to proof and witnesses, regardless of who prevails, unless applicable law and/or the Code gives a party the right to recover any of those fees from the other party. An arbitration award may not be set aside except upon the limited circumstances set forth in the Federal Arbitration Act. An award in arbitration will be enforceable under the Federal Arbitration Act by any court having jurisdiction. The time for commencing an arbitration asserting any Claim shall be determined by reference to the applicable statute(s) of limitations, including the applicable rules governing the commencement of the limitations period, and a Claim in arbitration is barred to the same extent it would be barred if it were asserted in court of law or equity rather than in arbitration.

If any portion of this Arbitration Agreement is deemed invalid or unenforceable, all the remaining portions of this Arbitration Agreement shall nevertheless remain valid and enforceable, provided, however, that if any portion of the Class Action Waiver is deemed invalid or unenforceable, then this Arbitration Agreement shall be invalidated and unenforceable in its entirety. In the event of a conflict or inconsistency between this Arbitration Agreement and Class Action Waiver and the other provisions of this Agreement or any other agreement, this Arbitration Agreement and Class Action Waiver governs.

OPT-OUT PROVISION. YOU SHALL HAVE THE RIGHT TO OPT OUT OF THIS ARBITRATION AGREEMENT AND CLASS ACTION WAIVER BY PROVIDING WRITTEN NOTICE OF YOUR INTENTION TO DO SO TO US WITHIN THIRTY (30) DAYS OF THE PURCHASE OF THIS AGREEMENT (THE DATE OF PURCHASE BEING INDICATED ON YOUR SALES ORDER AND RECEIPT FROM THE SELLING RETAILER). To opt out, You must send written notice to either: (1) 10151 Deerwood Park Blvd., Building 100, Suite 500, Jacksonville, FL 32256, Attn: Legal or (2) legal@fortegra.com, with the subject line, “Arbitration Opt Out.” You must include in Your opt out notice: (a) Your name and address; (b) the date You purchased Your Agreement; and (c) the Selling Retailer. If You properly and timely opt out, then all Claims will be resolved in court rather than arbitration.

13. Cancellation: This Agreement provides a sixty (60) day free look period from the purchase date of the Agreement. You may cancel this Agreement by informing the Selling Retailer of Your cancellation request within sixty (60) days from the date of purchase of the Agreement and You will receive a 100% refund of the full purchase price of the Agreement. If Your cancellation request is made more than sixty (60) days from the date of purchase, You will receive a pro-rata refund of the Agreement purchase price, less the cost of repairs made (if any), and less an administrative fee to not exceed the cost of the contract or [$50.00] whichever is less; or the state law for cancellation that apply to residents requesting cancellation. We may not cancel this Agreement except for fraud, material misrepresentation, or non-payment by You, or if required to do so by a regulatory authority. A written notice will be provided at least thirty (30) days prior to cancellation at Your last known address, with the effective date for the cancellation and the reason for cancellation. Return of the premium is based upon 100% of the unearned pro-rata premium.] [If the Term indicated on the Your sales receipt, or invoice is “Monthly”, coverage continues as long as the monthly Agreement fees are paid by You in full by the billing due date. Notice of any changes to rate and/or Agreement provisions will be given to You, in writing, at least thirty (30) days prior to implementation. You may terminate coverage by giving written notice at any time prior to the effective date of the change.]

14. Entire Agreement: This is the entire Agreement between the parties, and no representation, promise or condition made by any person or entity which is not contained herein shall modify any of the terms or conditions of this Agreement.

15. Limited Applicability of the Federal Magnuson Moss Warranty Act: You agree and acknowledge that You have paid an additional fee for this Agreement that is separate and apart from the purchase price You paid for the Covered Product(s). Because of that separately stated consideration, You agree and acknowledge that this Agreement is not part of the basis of the bargain for Your purchase of the Covered Product(s). You further agree and acknowledge that We, and the Administrator under this Agreement, are not the supplier of the Covered Product(s). Consequently, this Agreement is not a “written warranty” under the federal Magnuson Moss Warranty Act. As a result, this Agreement is not subject to the provisions of the Magnuson Moss Warranty Act that apply only to a “written warranty”.

16. LIMITATION OF LIABILITY:

THIS AGREEMENT SETS OUT THE FULL EXTENT OF OUR RESPONSIBILITIES. NEITHER THE OBLIGOR NOR THE ADMINISTRATOR SHALL BE LIABLE FOR SPECIAL, INDIRECT, INCIDENTAL, PUNITIVE OR CONSEQUENTIAL DAMAGES (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTION, EXPENSES ARISING OUT OF THIRD PARTY CLAIMS, LOSS OF USE OF THE COVERED PRODUCT, INCONVENIENCE, OR ANY OTHER LOSS), WHETHER OR NOT CAUSED BY OR RESULTING FROM BREACH OF CONTRACT, NEGLIGENCE, OR OTHER WRONGFUL ACT OR OMISSION, EVEN IF IT HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. NEITHER THE OBLIGOR NOR THE ADMINISTRATOR AUTHORIZE ANY PERSON, ENTITY OR SELLING RETAILER TO CREATE FOR THEM ANY OTHER OBLIGATION OR LIABILITY IN CONNECTION WITH THIS AGREEMENT.

17. INSURANCE: OUR OBLIGATIONS TO PERFORM UNDER THIS AGREEMENT ARE INSURED BY [“LYNDON SOUTHERN INSURANCE COMPANY”, 10151 DEERWOOD PARK BLVD., BLDG. 100, SUITE 500, JACKSONVILLE, FL 32256 (800) 888-2738], EXCEPT IN CALIFORNIA, GEORGIA, NEW YORK, RHODE ISLAND, WASHINGTON AND WISCONSIN.

CALIFORNIA - THE OBLIGOR IS INSURED BY [“RESPONSE INDEMNITY COMPANY OF CALIFORNIA”, [10151 DEERWOOD PARK BLVD., BLDG. 100, SUITE 500, JACKSONVILLE, FL 32256 (800) 888-2738].

GEORGIA - THE OBLIGOR IS INSURED BY [“INSURANCE COMPANY OF THE SOUTH”, 10151 DEERWOOD PARK BLVD., BLDG. 100, SUITE 500, JACKSONVILLE, FL 32256 (800) 888-2738].

NEW YORK AND WISCONSIN - THE OBLIGOR IS INSURED BY [“BLUE RIDGE INDEMNITY COMPANY”, 10151 DEERWOOD PARK BLVD., BLDG. 100, SUITE 500, JACKSONVILLE, FL 32256 (800) 888-2738].

RHODE ISLAND - THE OBLIGOR IS INSURED BY [“ATLANTIC SPECIALTY INSURANCE COMPANY”, 605 NORTH HIGHWAY 169, SUITE 800, PLYMOUTH, MN 55441].

IF THE OBLIGOR FAILS TO PAY AN AUTHORIZED CLAIM WITHIN SIXTY (60) DAYS, OR IF THE OBLIGOR BECOMES INSOLVENT OR CEASES TO CONDUCT BUSINESS DURING THE TERM OF THIS AGREEMENT, YOU MAY SUBMIT YOUR CLAIM DIRECTLY TO THE APPLICABLE INSURER ARE THE ABOVE ADDRESS FOR CONSIDERATION.

FINANCIAL GUARANTEE:
IN WASHINGTON, OUR OBLIGATIONS UNDER THIS AGREEMENT ARE BACKED BY THE FULL FAITH AND CREDIT OF THE SERVICE CONTRACT PROVIDER, 4WARRANTY CORPORATION. IF ANY PROMISE MADE IN THE AGREEMENT HAS BEEN DENIED OR HAS NOT BEEN HONORED YOU MAY CONTACT FORTEGRA FINANCIAL CORPORATION AT (800) 888-2738.

19. STATE REQUIREMENTS AND DISCLOSURES:

AlabamaCANCELLATION section is amended as follows: A cancellation fee not to exceed twenty-five dollars ($25.00) will be charged for cancellations occurring after sixty (60) days. No cancellation fee will be charged if We cancel Your Agreement. A ten percent (10%) penalty per month shall be applied to refunds not paid or credited within forty-five (45) days of receipt of returned Agreement.
ArizonaIn the “WHAT IS NOT COVERED” section of this Agreement, exclusion (E) is removed. CANCELLATION section is amended as follows: No claim incurred or paid will be deducted from the amount to be returned in the event of cancellation. An administrative fee not to exceed ten percent (10%) of the provider fee paid by the Agreement Holder may be charged by the provider. Arbitration does not preclude the consumer’s right to file a complaint with the Arizona Department of Insurance Consumer Affairs Division, (800) 325-2548. Exclusions listed in the Agreement apply once the Covered Product is owned by You.
Arkansas: CANCELLATION section is amended as follows: A ten percent (10%) penalty per month shall be applied to refunds not paid or credited within forty-five (45) days of receipt of returned Agreement.
Section 17 – Insurance is amended as follows: "Obligations of the provider under this Agreement are guaranteed under a service contract reimbursement insurance policy. If the provider fails to pay or provide service on a claim within sixty (60) days after proof of loss has been filed, You are entitled to make a claim directly against the insurance company".
CaliforniaCANCELLATION section is amended as follows: This Agreement provides a sixty (60) day free look period from the receipt of the Agreement. You may cancel this Agreement by informing the Selling Retailer of Your cancellation request within sixty (60) days from the receipt of the Agreement and You will receive a 100% refund of the full purchase price of the Agreement. If Your cancellation request is made more than sixty (60) days from the receipt of your Agreement, You will receive a pro-rata refund of the Agreement purchase price, less the cost of repairs made (if any), and less an administrative fee, not to exceed ten percent (10%) of the Agreement purchase price or twenty-five dollars ($25), whichever is less. A ten percent (10%) penalty per month shall be applied to refunds not paid or credited within thirty (30) days of receipt of returned Agreement. Arbitration provision does not prohibit a California resident from following the process to resolve complaints as outlined by the California Bureau of Electronic and Appliance Repair (BEAR). Colorado: Section 17 – Insurance is amended as follows: "Obligations of the provider under this Agreement are guaranteed under a service contract reimbursement insurance policy. If the provider fails to pay or provide service on a claim within sixty (60) days after proof of loss has been filed, You are entitled to make a claim directly against the insurance company".
Connecticut: If You purchased this Agreement in Connecticut, You may pursue arbitration to settle disputes between You and the provider of this Agreement. You may mail Your complaint to: State of Connecticut, Insurance Department, P.O. Box 816, Hartford, Connecticut 06142-0816, Attention: Consumer Affairs. The written complaint must describe the dispute, identify the price of the product and cost of repair, and include a copy of this Agreement. In the event Your is being serviced by an authorized service center when this Agreement expires, the term of this Agreement will be extended until the covered repair has been completed. CANCELLATION section is amended as follows: You may cancel this Agreement if You return the Product or the Product is sold, lost, stolen, or destroyed.
FloridaThis Agreement is between the Provider, Lyndon Southern Insurance Company (License No. 03698) and You, the purchaser. If You cancel this Agreement, return of premium shall be based upon ninety percent (90%) of the unearned pro-rata premium less any claims that have been paid or less the cost of repairs made on Your behalf. If this Agreement is cancelled by the Provider or Administrator, return of premium shall be based upon one hundred percent (100%) of the unearned pro-rata premium less any claims that have been made or less the cost of repairs made on Your behalf. The rate charged for this service contract is not subject to regulation by the Florida Office of Insurance Regulation. Arbitration section is amended to add the following: Arbitration proceedings shall be conducted in the county in which the consumer resides.
Georgia: Coverage is effective upon the expiration of the shortest portion of the manufacturer’s warranty. CANCELLATION section is amended as follows: If You cancel after thirty (30) days of receipt of Your Agreement, You will receive a pro rata refund of the Agreement price. In the event of cancellation by Us, notice of such cancellation will be in writing and given at least thirty (30) days prior to cancellation. Cancellation will comply with Section 33-24-44 of the Code of Georgia. Claims paid and cancellation fees shall not be deducted from any refund owed as a result of cancellation. Any refund owed and not paid as required is subject to a penalty equal to twenty-five percent (25%) of the refund owed and interest of eighteen percent (18%) per year until paid; however, such penalty shall not exceed fifty percent (50%) of the amount of the refund. We may not cancel this Agreement except for fraud, material misrepresentation, or non-payment by You. ARBITRATION section of this Agreement is removed. In the “WHAT IS NOT COVERED” section of this Agreement, exclusion (E) is removed and replaced with: Any and all pre-existing conditions known by You that occur prior to the effective date of this Agreement and/or any sold “AS-IS” including but not limited to floor models, demonstration models, etc.
Hawaii: CANCELLATION section is amended as follows: A ten percent (10%) penalty per month shall be applied to refunds not paid or credited within forty-five (45) days of receipt of returned Agreement.
Idaho: Section 17 – Insurance is amended as follows: "Obligations of the provider under this Agreement are guaranteed under a service contract reimbursement insurance policy. If the provider fails to pay or provide service on a claim within sixty (60) days after proof of loss has been filed, You are entitled to make a claim directly against the insurance company".
Indiana: Section 17 – Insurance is amended as follows: "Obligations of the provider under this Agreement are guaranteed under a service contract reimbursement insurance policy. If the provider fails to pay or provide service on a claim within sixty (60) days after proof of loss has been filed, You are entitled to make a claim directly against the insurance company".
Iowa: CANCELLATION section is amended as follows: A ten percent (10%) penalty per month shall be applied to refunds not paid or credited within thirty (30) days of receipt of returned Agreement.
Maine: CANCELLATION section is amended as follows: The provider of the Agreement shall mail a written notice to the Agreement Holder at the last known address of the Agreement Holder contained in the records of the provider at least fifteen (15) days prior to cancellation by the provider. The notice must state the effective date of the cancellation and the reason for the cancellation. If an Agreement is cancelled by the provider for a reason other than nonpayment of the provider fee, the provider shall refund to the Agreement Holder one hundred percent (100%) of the unearned pro-rata provider fee, less any claims paid. An administrative fee not to exceed ten percent (10%) of the provider fee paid by the Agreement Holder may be charged by the provider. A monthly penalty equal to ten percent (10%) of the outstanding provider fee outstanding must be added to a refund that is not paid or credited within forty-five (45) days after the return of the Agreement to the provider.
Section 17 – Insurance is amended as follows: "If the provider fails to pay or provide service on a claim, including any claim for the return of the unearned portion of the provider fee, within 60 days after proof of loss has been filed, You are entitled to make a claim directly against the insurance company."
Maryland: CANCELLATION section is amended as follows: A ten percent (10%) penalty per month shall be applied to refunds not paid or credited within forty-five (45) days of receipt of returned Agreement.
Massachusetts: CANCELLATION section is amended as follows: The provider shall mail a written notice to the Agreement Holder, including the effective date of the cancellation and the reason for the cancellation at the last known address of the Agreement Holder contained in the records of the provider at least five (5) days prior to cancellation by the provider unless the reason for cancellation is nonpayment of the provider fee, material misrepresentation or a substantial breach of duties by the Agreement Holder relating to the Covered Product or its use. A ten percent (10%) penalty per month shall be applied to refunds not paid or credited within forty-five (45) days of receipt of returned Agreement.
Michigan: If performance under this Agreement is interrupted because of a strike or work stoppage at Our place of business, the effective period of the Agreement shall be extended for the period of the strike or work stoppage.
Minnesota: CANCELLATION section is amended as follows: A ten percent (10%) penalty per month shall be applied to refunds not paid or credited within forty-five (45) days of receipt of returned Agreement.
Mississippi:

1.) This Agreement includes a binding Arbitration agreement.
2.) The Arbitration agreement requires that any dispute related to Your coverage must be resolved by Arbitration and not in a court of law.
3.) The results of the Arbitration are final and binding on You and Us.
4.) In an Arbitration, one or more arbitrators, who are independent, neutral decision makers, render a decision after hearing the positions of the parties.
5.) When You become a Agreement holder under this Agreement You must resolve any dispute related to the Agreement by binding arbitration instead of a trial in court, including a trial by jury.
6.) Binding arbitration generally takes the place of resolving disputes by a judge and jury.

Missouri: CANCELLATION section is amended as follows: A ten percent (10%) penalty per month shall be applied to refunds not paid or credited within forty-five (45) days of receipt of returned Agreement.
Section 17 – Insurance is amended as follows: "Obligations of the provider under this Agreement are guaranteed under a service contract reimbursement insurance policy. If the provider fails to pay or provide service on a claim within sixty (60) days after proof of loss has been filed, You are entitled to make a claim directly against the insurance company".
Nevada: CANCELLATION section is amended as follows: A twenty-five dollar ($25) cancellation fee is applicable. No claim incurred or paid will be deducted from the amount to be returned in the event of cancellation. We may not cancel this Agreement without providing You with written notice at least fifteen (15) days prior to the effective date of cancellation. Such notice shall include the effective date of cancellation and the reason for cancellation. A ten percent (10%) penalty per month shall be applied to refunds not paid or credited within thirty (30) days of receipt of returned Agreement. ARBITRATION section of this Agreement is removed.
The cost of claims paid or services provided will not, under any circumstances, be deducted from any refund issued pursuant to this Agreement.
If You are not satisfied with the manner in which we are handling a claim under this Agreement, You may contact the Nevada Division of Insurance toll free at 888-872-3234.
This Agreement will not cover any unauthorized or non-manufacturer recommended modifications to the Covered Product, or any damages arising from such unauthorized or non-manufacturer recommended modifications. However, if the Covered Product is modified or repaired in an unauthorized or non-manufacturer recommended manner, We will not automatically suspend all coverage. Rather, this Agreement will continue to provide any applicable coverage that is not related to the unauthorized or non-manufacturer recommended modification or any damages arising therefrom, unless such coverage is otherwise excluded by the terms of this Agreement.
New Hampshire: In the event You do not receive satisfaction under this Agreement, You may contact the New Hampshire Insurance Department, 21 South Fruit Street, Concord, NH 03301, (603) 271-2261. ARBITRATION section of this Agreement is removed.
New Jersey: CANCELLATION section is amended as follows: A ten percent (10%) penalty per month shall be applied to refunds not paid or credited within forty-five (45) days of receipt of returned Agreement.
New Mexico: CANCELLATION section is amended as follows: We may not cancel this Agreement without providing You with written notice at least fifteen (15) days prior to the effective date of cancellation. Such notice shall include the effective date of cancellation and the reason for cancellation. If this Agreement has been in force for a period of seventy (70) days, We may not cancel it before the expiration of the Agreement term or one (1) year, whichever occurs first, unless: 1) You fail to pay any amount due; 2) You are convicted of a crime which results in an increase in the service required under the Agreement; 3) You engage in fraud or material misrepresentation in obtaining this Agreement; or 4) You commit any act, omission, or violation of any terms of this Agreement after the effective date of this Agreement which substantially and materially increases the service required under this Agreement. A ten percent (10%) penalty per month shall be applied to refunds not paid or credited within sixty (60) days of receipt of a returned Agreement.
New York: CANCELLATION section is amended as follows: A ten percent (10%) penalty per month shall be applied to refunds not paid or credited within thirty (30) days of receipt of returned Agreement.
Section 17 – Insurance is amended as follows: "Obligations of the provider under this Agreement are guaranteed under a service contract reimbursement insurance policy. If the provider fails to pay or provide service on a claim within sixty (60) days after proof of loss has been filed, You are entitled to make a claim directly against the insurance company".
North Carolina: CANCELLATION section is amended as follows: We may not cancel this Agreement except for nonpayment by You or for violation of any of the terms and conditions of this Agreement.
Ohio: Section 17 – Insurance is amended as follows: "Obligations of the provider under this Agreement are guaranteed under a service contract reimbursement insurance policy. If the provider fails to pay or provide service on a claim within sixty (60) days after proof of loss has been filed, You are entitled to make a claim directly against the insurance company".
Oklahoma: This Agreement is not a contract of insurance. Coverage afforded under this contract is not guaranteed by the Oklahoma Insurance Guaranty Association. CANCELLATION section is amended as follows: In the event You cancel this Agreement, return of premium shall be based upon ninety percent (90%) of the unearned pro rata premium, less any claims that have been paid or less the cost of repairs made on Your behalf. In the event We cancel this Agreement, return of premium shall be based upon one hundred percent (100%) of unearned pro rata premium, less any claims that have been paid or less the cost of repairs made on Your behalf. ARBITRATION – While arbitration is mandatory, the outcome of any arbitration shall be non-binding on the parties, and either party shall, following arbitration, have the right to reject the arbitration award and bring suit in a district court of Oklahoma.
Oregon: Upon failure of the Obligor to perform under the Agreement, the insurer shall pay on behalf of the Obligor any sums the Obligor is legally obligated to pay and any service that the Obligor is legally obligated to perform. Termination of the reimbursement policy shall not occur until a notice of termination has been mailed or delivered to the Director of the Department of Consumer and Business Services. This notice must be mailed or delivered at least thirty (30) days prior to the date of termination. CANCELLATION section is amended as follows: You, the Agreement Holder may apply for reimbursement directly to the insurer if a refund or credit is not paid before the 46th day after the date on which Your Agreement is returned to the provider. ARBITRATION section of this Agreement is removed.
South Carolina: If You purchased this Agreement in South Carolina, complaints or questions about this Agreement may be directed to the South Carolina Department of Insurance, P.O. CANCELLATION section is amended as follows: A ten percent (10%) penalty per month shall be applied to refunds not paid or credited within forty-five (45) days of receipt of returned Agreement.

Utah: This Agreement is subject to limited regulation by the Utah Insurance Department. To file a complaint, contact the Utah Insurance Department. Coverage afforded under this Agreement is not guaranteed by the Utah Property and Casualty Guaranty Association. Proof of loss should be furnished by You to the Administrator as soon as reasonably possible. Failure to furnish such notice or proof within the time required by this Agreement does not invalidate or reduce a claim. CANCELLATION section is amended as follows: We can cancel this Agreement during the first sixty (60) days of the initial annual term by mailing to You a notice of cancellation at least thirty (30) days prior to the effective date of cancellation except that We can also cancel this Agreement during such time period for non-payment of premium by mailing You a notice of cancellation at least ten (10) days prior to the effective date of cancellation. After sixty (60) days have elapsed, We may cancel this Agreement by mailing a cancellation notice to You at least ten (10) days prior to the cancellation date for non-payment of premium and thirty (30) days prior to the cancellation date for any of the following reasons: (a) material misrepresentation, (b) substantial change in the risk assumed, unless the We should reasonably have foreseen the change or contemplated the risk when entering into the Agreement, or (c) substantial breaches of contractual duties, conditions, or warranties. The notice of cancellation must be in writing to You at Your last known address and contain all of the following: (1) the Agreement number, (2) the date of notice, (3) the effective date of the cancellation and, (4) a detailed explanation of the reason for cancellation.
Any matter in dispute between You and the company may be subject to arbitration as an alternative to court action pursuant to the rules of (the American Arbitration Association or other recognized arbitrator), a copy of which is available on request from the company. Any decision reached by arbitration shall be binding upon both You and the company. The arbitration award may include attorney's fees if allowed by state law and may be entered as a judgment in any court of proper jurisdiction.
If after 5pm Eastern Time, You are unable to reach Administrator and You require emergency repair, You may contact any manufacturer authorized service repair facility listed in Your phone book or online. Mail Us Your original repair bill along with the technician’s report and a copy of the Agreement to the address at the top of this Agreement for reimbursement. All coverage and exclusions in this Agreement will apply.
Virginia: If any promise made in this Agreement has been denied or has not been honored within sixty (60) days after Your request, You may contact the Virginia Department of Agriculture and Consumer Services, Office of Charitable and Regulatory Programs at www.vdacs.virginia.gov/food-extended-service-contract-providers.shtml to file a complaint.
Washington: All references to Obligor throughout this Agreement are replaced with Service Provider. A ten percent (10%) penalty per month shall be applied to refunds not paid or credited within thirty (30) days of receipt of returned service agreement. We may not cancel this Agreement without providing You with written notice at least twenty-one (21) days prior to the effective date of cancellation. Such notice shall include the effective date of cancellation and the reason for cancellation. You are not required to wait sixty (60) days before filing a claim directly with the Service Provider. ARBITRATION section is amended to add the following: The Insurance Commissioner of Washington is the Service Provider’s attorney to receive service of process in any action, suit or proceeding in any court, and the state of Washington has jurisdiction of any civil action in connection with this Agreement. Arbitration proceedings shall be held at a location in closest proximity to the service Agreement holder’s permanent residence. You may file a direct claim with the Service Provider at any time.
EMERGENCY SERVICE: If after 5pm Eastern Time, You are unable to reach Administrator and You require emergency repair, You may contact any manufacturer authorized service repair facility listed in Your phone book or online. Mail Us Your original repair bill along with the technician’s report and a copy of the Agreement to the address at the top of this Agreement for reimbursement. Wisconsin: ARBITRATION section of this Agreement is removed. CANCELLATION section is amended as follows: This Agreement may be cancelled by Us only for nonpayment of the provider fee, material misrepresentation by You to Us or the Administrator, or substantial breach of duties by You relating to the covered product or it use. If We cancel this Agreement, We will provide written notice of cancellation, including the effective date of the cancellation and the actual reason for the cancellation, to the last known mailing address at least five (5) days prior to the effective date of the cancellation. If We cancel this Agreement, We or the Seller will refund You one hundred percent (100%) of the Agreement purchase price, less any claims paid on Your Agreement. We may charge a reasonable administrative fee for cancellation, which may not exceed ten percent (10%) of the provider fee. If You cancel within sixty (60) days of receipt of Your Agreement, You must first return to the Selling Retailer or to the Obligor should the Selling Retailer not be available. Proof of loss should be furnished by You to the Administrator as soon as reasonably possible and within one (1) year after the time required by this Agreement. Failure to furnish such notice or proof within the time required by this Agreement does not invalidate or reduce a claim. A ten percent (10%) penalty per month shall be applied to refunds not paid or credited within forty-five (45) days of receipt of returned Agreement.
THIS CONTRACT IS SUBJECT TO LIMITED REGULATION BY THE OFFICE OF THE COMMISSIONER.
If Administrator fails to provide, or reimburse or pay for, a service that is covered under this Agreement within sixty-one (61) days after You provide proof of loss, or if the Administrator becomes insolvent or otherwise financially impaired, You may file a claim directly with the Insurer for reimbursement, payment, or provision of the service.
Wyoming: CANCELLATION section is amended as follows: A ten percent (10%) penalty per month shall be applied to refunds not paid or credited within forty-five (45) days of receipt of returned Agreement. ARBITRATION section of this Agreement is removed.
